Q1: How much does it cost to file on a deceased's estate or open a guardianship?
A: See Fee Schedule

 

 

 

Q2: What does that fee cover?
A: The initial filing fees and required citation(s). If the estate/guardianship is 90 days or older (from the date of the file is opened), additional fees are required: $3.00 for the first page; $2.00 for each succeeding page' $2.00 for the judge's signature, where applicable; and, $45.00 for each service required.

 

 

 

Q3: How much does certified copies cost and can I wait on them?
A: The cost for certified copies is $5.00 for each document certified, plus $1.00 for each page. The cost for non-certified copies is $1.00 per page. It takes several hours to create the copies. You can either pick up your copies in the office or the copies can be mailed to you at your request.

 

 

 

Q4: Can I pick up a Letters Testamentary at your office?
A: Before Letters Testamentary can be issued, the court must appoint a personal representative and that person(s) must qualify according to the law. This is true for any other type of certificate of appointment, i.e. Letters of Administration or Letters of Guardianship.

 

 

 

Q5: Is my hearing date automatically set when I file for probate?
A: The hearing date is set by the attorney of record or the applicant by calling the appropriate court clerk no earlier than the week before the citation return date. The court appearance will be after the citation return date.

 

 

 

Q6: Does the Clerk's Office have any forms that I can use and if so, how much does it cost?
A: Forms are available in the Clerk's Office at no charge. The forms may be mailed at the customer's request. See Downloadable Forms on this site.

 

 

 

Q7: Can I record my Will?
A: The Will of a living person may not be recorded. If one wants to file his/her Will in safekeeping with the Clerk's Office, there will be a $5.00 fee.

 

 

 

Q8:Can I bring down a Will and file it for probate?
A: Certain facts must be stated in an original application before the Clerk's Office may accept a Will for probate.

 

 

 

Q9: Can I file a probate proceeding, order Letters of Testamentary, Guardianship, Administration, or Congressional Certificates at an annex?
A: No, the only place one can accomplish any the above is at the downtown location.

 

 

 

Q10: Can I return a subpoena to the annex?
A: Yes
